Theodore Maiso vs. State of California, Department of Mental Health, State Compensation Insurance Fund, State Contract Services

This case involves a petition for reconsideration by applicant Theodore Maiso against the State of California, Department of Mental Health. The Workers' Compensation Appeals Board denied reconsideration, adopting the WCJ's report and reasoning. The Board also corrected a technicality by ordering the substitution of "State of California, Division of Workers' Compensation, Workers' Compensation Appeals Board" in place of "State of California, Division of Workers' Compensation" in the WCJ's decision headings to accurately reflect the judicial authority.

The Workers' Compensation Appeals Board denied reconsideration of a WCJ's findings on an applicant's right hand injury. The Board adopted the WCJ's report, emphasizing the deference given to the WCJ's credibility determinations. The Board also corrected a minor clerical error in the WCJ's report heading, substituting "Workers' Compensation Appeals Board" for "Division of Workers' Compensation."

JUAN LOCOCO vs. HUMBLE POTATO LLC, EMPLOYERS PREFERRED INSURANCE COMPANY

The Workers' Compensation Appeals Board granted reconsideration of the judge's award finding applicant sustained injury arising out of and occurring in the course of employment (AOE/COE) to his back. The Board found the applicant's medical report from Dr. Donahue was not substantial evidence as it was based on an inaccurate history and potentially obtained after discovery closed, thus prejudicing the defendant. Consequently, the Board rescinded the prior award and returned the matter to the judge for further development of the record and proceedings. This will allow for proper due process and ensure the record contains substantial evidence before a new decision is made.

RUDY PINEDA vs. VENETIAN FURNITURE GALLERY, STATE FARM INSURANCE COMPANIES

In this Workers' Compensation Appeals Board case, lien claimants sought to depose the employer after the case had been continued multiple times and discovery was ordered closed. The Administrative Law Judge (PWCJ) properly quashed the deposition notice, finding no demonstrated prejudice to the lien claimants. The Board affirmed the PWCJ's decision, concluding that the judge acted within their authority to close discovery when parties have had sufficient opportunity. The lien claimants' petition for removal was therefore denied.

FRANCISCO MARIN vs. MERCHANTS OF TENNIS, INC.

The WCAB granted reconsideration of an order dismissing a lien claimant's lien. The lien was dismissed due to the claimant's failure to object to a Notice of Intention to Dismiss. However, the record was unclear regarding what transpired at a subsequent lien trial where the claimant's representative appeared and all liens were purportedly resolved. The Board found the dismissal order lacked proper evidentiary basis and returned the matter for further proceedings.

ROSALINDA RODRIGUEZ vs. MERCURY INSURANCE SERVICES, LLC, TRAVELERS PROPERTY & CASUALTY COMPANY OF AMERICA

The Appeals Board granted the defendant's Petition for Removal, rescinding the WCJ's order that removed the case from calendar due to lack of jurisdiction. The WCJ erred in finding he could not rule on the defendant's petition to strike the applicant's request for additional QME panels. The Board determined that Labor Code section 133 and WCAB Rule 10348 grant the WCJ jurisdiction to determine the reasonableness and necessity of such requests. The case is returned to the WCJ to decide whether additional QME panels are warranted.
