The Workers' Compensation Appeals Board dismissed defendant's petition for removal. The Board found that a subsequent order by the WCJ sustaining defendant's objection to applicant's Petition for Costs effectively rescinded the order the defendant sought to remove. Therefore, the petition for removal was dismissed by operation of law, as the issues are now set for a hearing and any aggrieved party can seek reconsideration of the WCJ's final decision.
