WILLIAM CASNER vs. STATE OF CALIFORNIA, DEPARTMENT OF CORRECTIONS AND REHABILITATION, STATE COMPENSATION INSURANCE FUND

The Workers' Compensation Appeals Board denied reconsideration of an applicant's claim for a cardiac injury. The Board adopted the findings of the WCJ, who determined that the applicant's claim was timely filed. The WCJ found that while the applicant knew of his heart condition, he did not reasonably know it was work-related until March 2013, at which point he filed his claim. The Board affirmed the WCJ's credibility findings and the application of the heart presumption under Labor Code §3212.2.
