Oefelein v. CFI Construction Inc.

Plaintiff Keith Oefelein sustained a right shoulder injury after tripping over an exposed plastic gas pipe at a school renovation site on September 17, 2001. He and his spouse filed a personal injury action against CFI Construction, Inc., the prime contractor, and Amerigas Propane, L.P., the gas vendor. The Supreme Court granted summary judgment to both defendants, dismissing the complaint. On appeal, the court affirmed, finding no evidence that either defendant created or exacerbated the dangerous condition. The court noted that neither defendant performed work at the site for three weeks prior to the accident, and the area was backfilled and inspected, deemed complete. The court concluded that there was no support for the claim that the area was left less safe by the defendants.

CON HOWE vs. AMERIGAS by SPECIALTY RISK SERVICES

This case involves an applicant's petition to disqualify a Workers' Compensation Administrative Law Judge (WCJ) due to alleged bias stemming from a prior incident. The applicant's attorney claimed the WCJ harbored enmity and would prejudice his clients. The WCJ, in his report, stated the incident would not affect his impartiality and all cases are decided on evidence. The Appeals Board adopted the WCJ's report and denied the disqualification petition, finding no reason to doubt the WCJ's impartiality.

RANDY JOHNSON vs. AMERIGAS PROPANE, ACE INSURANCE, administered by SEDGWICK CMS

This case involves a petition for reconsideration by the defendant regarding an award for temporary disability and medical treatment. The Appeals Board granted the petition, rescinded the original award, and returned the matter to the trial level for further proceedings. The Board noted discrepancies in the evidentiary record and admonished the defendant for contradicting its own stipulations and referencing evidence not submitted. The WCJ must clarify specific details in any new decision, including the exact temporary disability dates and rates, awarded medical treatment, and the basis for attorney fees.
