Security Union Ins. Co. v. Cartwright
Henry Cartwright, an employee of Union City Transfer Company, died on May 15, 1927, from a cerebral hemorrhage and apoplexy following an alleged work-related injury on May 14, 1927. His widow, Ella Cartwright, filed a claim for compensation with the Industrial Accident Board, which was denied on January 19, 1928, after the Board concluded his death was due to natural causes. Ella Cartwright subsequently filed suit in the District Court of Jefferson County, Texas. A jury found in her favor, awarding compensation. The Security Union Insurance Company, the employer's insurer, appealed this judgment, arguing the District Court lacked jurisdiction because the death claim for the May 14th injury had not been properly adjudicated by the Industrial Accident Board. The appellate court, however, determined that the Industrial Accident Board had indeed considered and denied the death claim, thus affirming the District Court's judgment.
