Matter of Board of Mgrs. of Half Moon Bay Mar. Condominium v. Board of Directors of Half Moon Bay Homeowners Assn., Inc.

This case concerns a CPLR article 78 proceeding initiated by the Board of Managers of Half Moon Bay Marina Condominium and Maria Elena DiBella against the Board of Directors of Half Moon Bay Homeowners Association, Inc. The dispute arose over the voting rights of Marina directors on the HOA Board, which the HOA Board sought to restrict. The Supreme Court, Westchester County, ruled in favor of the petitioners, compelling the HOA Board to allow unrestricted voting. Board of Education of the Union-Endicott Central School District v. New York State Public Employment Relations Board

The Board of Education of Union-Endicott Central School District initiated a CPLR article 78 proceeding to annul a Public Employment Relations Board (PERB) determination that certified the Endicott Teachers' Association as the exclusive negotiating agent for former members of OTASN. The School Board argued that permitting a non-attorney to represent the Teachers' Association violated Judiciary Law §§ 478 and 484, and that PERB's director improperly made the decision instead of the Administrative Law Judge who presided over the hearing. The court agreed with the School Board on both points, finding PERB's rule allowing lay representation to contravene state law and the director's decision arbitrary and capricious. Consequently, the court annulled PERB's determination and remanded the matter for a new hearing. Additionally, a motion to dismiss by Kathleen Osiecki, president of OTASN, was granted as OTASN was not formally a party to the proceeding.

Claim of Schwartz v. State Insurance Fund

Matter of Gomez v. Board of Mgrs. of Cipriani

Alberto Gomez, the claimant, sustained work-related injuries in 2017 and sought payment for medical treatment from a New Jersey-licensed physician who was also licensed in New York but not authorized by the Workers' Compensation Board. Filippi v. Elmont Union Free School District Board of Education

Plaintiff Karen Filippi filed an employment discrimination and retaliation lawsuit against her employer, the Elmont Union Free School District Board of Education, Superintendent Al Harper, and administrator Robert Geras. Defendants moved to disqualify plaintiff's counsel, the Law Offices of Steven A. Morelli and Eric Tilton, due to a conflict of interest. An associate at the Morelli Firm, Lorraine Ferrigno, also serves as the Vice President of the defendant Board of Education. The Court found a clear and unwaivable conflict of interest under New York State Rules of Professional Conduct Rule 1.7 and Rule 1.11, as Ferrigno had a fiduciary duty to the Board and personally received letters regarding Filippi's claims. Despite screening measures, the Court deemed them insufficient in the small, six-lawyer firm and concluded the conflict was non-waivable. The motion to disqualify both the Morelli Firm and Eric Tilton, due to his close affiliation, was granted.

Claim of Ostuni v. Town of Ramapo

Claimant appealed from a decision of the Workers’ Compensation Board, filed July 22, 2002, which denied her application for reconsideration and/or full Board review of a prior decision. The prior decision had ruled that claimant did not sustain a work-related injury, citing insufficient credible evidence. The appellate court affirmed the Board's denial, finding that the Board fully considered all evidence and no new, previously unavailable evidence was offered to warrant altering its decision. Furthermore, the court found substantial evidence supported the Board’s September 2001 decision that claimant’s injuries were not compensable, as her recurring lower back pain stemmed from injuries predating or following the alleged November 1990 incident, rather than the incident itself. The court also upheld the Board's rejection of contrary testimony as not credible.

Matter of Madigan v. ARR ELS

In 1994, the claimant sustained a low back injury during employment as a machinist, leading to workers' compensation benefits. Liability for the case was transferred to the Special Fund for Reopened Cases in 2003. Due to poor surgical outcomes, the claimant has been on pain medication, including oxycontin, since at least 2007, with doses escalating. A consultant for the Special Fund questioned the necessity of the increased medication, prompting a hearing. A Workers’ Compensation Law Judge ruled that the pain medications should continue, with the Special Fund covering the costs, until new Board guidelines or physician recommendations advised otherwise. The Workers’ Compensation Board affirmed this decision, citing that their Medical Treatment Guidelines for chronic pain were still in draft form at the time. The appellate court subsequently affirmed the Board's decision, noting that the guidelines were not yet in effect at the time of the Board's ruling and that the Board's interim guidance was rational.

Claim of Elias v. New York City Human Resources Administration
