McCantz v. Brotherhood of Painters, Decorators & Paperhangers of America
J. J. McCantz sued The Brotherhood of Painters, Decorators and Paperhangers of America after a local union refused his dues, causing him to lose union standing and benefits. McCantz challenged a $50 fine imposed by Local Union No. 130, arguing it was void due to lack of notice and procedural violations. The trial court had instructed a verdict in favor of the Brotherhood. The appellate court determined that the fine against McCantz was absolutely void because the union failed to notify him of reconsideration proceedings and subsequent fining, thereby invading his property rights. Consequently, McCantz was not required to exhaust internal union appeals before seeking civil court redress for damages. The court affirmed the lower court's judgment on punitive damages but reversed and remanded for a new trial on actual damages.
