Guepet v. International TAO Systems, Inc.
The plaintiff, a computer programmer, sued a corporate defendant for unpaid wages for work, labor, and services. The defendant counterclaimed for wage repayment due to alleged improper performance and sought injunctive relief for a breach of a restrictive covenant. The court determined the plaintiff was an employee, not an independent contractor, and was protected by Labor Law § 193, which prohibits wage deductions for poor performance. Consequently, the defendant's counterclaims for wage recovery were dismissed. The defendant's defense of duress was also rejected. The court granted the plaintiff partial summary judgment against the corporate defendant for $10,499.37, while other claims and counterclaims against individual defendants were severed.
