Statler v. Dell, Inc.
Plaintiff Richard Statler sued Dell, Inc., alleging malfunction of five Optiplex computers purchased in 2003, citing causes of action including violation of the Federal Magnuson Moss Warranty Act, New York Uniform Commercial Code, New York General Business Law Section 349, and unjust enrichment. The issues stemmed from allegedly defective capacitors Dell was accused of concealing. Dell moved to dismiss the complaint, primarily on timeliness grounds and the inapplicability of certain statutes. The District Court ruled that warranty claims accrued in 2003 but deferred ruling on equitable tolling. The court dismissed claims based on unmanifested safety hazards and unjust enrichment due to the existence of a contract, while allowing the Section 349 claim to proceed regarding post-delivery deceptive conduct.
