Friedlander v. Rhoades
Plaintiff, a former partner of Odette Realty Company, brought a civil Racketeer Influenced and Corrupt Organizations Act (RICO) claim against Daniel Rhoades, Norma Rhoades, and their law firm, Rhoades and Rhoades, P.C. The plaintiff alleged that the Rhoades Defendants provided fraudulent legal advice, leading to significant financial losses including a $10 million judgment against her and the non-payment of mortgage funds. The defendants moved to dismiss, arguing the complaint failed to state a valid RICO claim and was barred by the statute of limitations. The Court granted the motion, finding that the plaintiff failed to establish a distinct RICO enterprise and lacked specificity in alleging racketeering acts. Most of the claims were also time-barred by the four-year RICO statute of limitations. The Court also declined supplemental jurisdiction over state law claims and denied leave to amend the complaint.
