Tubens v. Police Dept. of City of New York
Evelyn Tubens, a former NYPD probationary police officer, brought an action against the NYPD alleging wrongful termination based on perceived physical disability (mitral valve prolapse) and race/sex discrimination under the ADA and Title VII. Tubens was terminated after a chief surgeon determined she could not perform police duties due to her heart condition, despite her claim that she was fully capable. The court granted summary judgment for the defendant, finding that Tubens failed to establish a prima facie case for perceived disability discrimination because she did not show the NYPD perceived her as substantially limited in a broad range of jobs, only in the specific job of a police officer. The court also found no rational basis for discrimination regarding her Title VII race and sex claims, as she offered no evidence that the NYPD's legitimate non-discriminatory reason for termination was a pretext for discrimination.
