Westchester County Correction Superior Officers Ass'n v. County of Westchester

Donegan v. Nadell

Petitioner Donegan, employed in Nassau courts since 1967, was promoted to Court Assistant II and began performing data entry duties following the installation of a computer system in 1973. However, the job specifications for her title did not include computer skills. When a new statewide classification plan was implemented, her position was converted to Principal Office Assistant, a title also lacking data entry duties. Donegan challenged this classification, arguing her actual duties warranted a classification as Data Entry Supervisor. Despite her grievance being partially granted and a provisional appointment to the data entry supervisor role, she was ineligible for permanent appointment due to not taking the required competitive examination. The court affirmed the administrative decision, emphasizing that civil service classifications must be based on "in-title" duties defined by job specifications, not "out-of-title" work performed, and that data entry skills required distinct competitive testing.

McLaurin v. New Rochelle Police Officers

Plaintiff Charles B. MeLaurin filed a pro se action under 42 U.S.C. § 1983 against numerous New Rochelle police officers and city officials, including Peter Kornas, Louis Falcone, Brian Fagan, David Lornegan, Edward Martinez, Dominic Procopio, Mayor Timothy Idoni, and the City of New Rochelle. MeLaurin alleged constitutional rights violations stemming from two arrests: one for assault on August 6, 2001, and another for criminal contempt on September 28, 2002. Defendants moved for judgment on the pleadings, asserting qualified immunity and failure to state a claim. The court granted dismissal with prejudice for most defendants, finding their actions objectively reasonable or lacking personal involvement, or due to plaintiff's failure to state a claim or comply with state law. Claims against Officers Lynch, Lore, Conca, Al-Fattaah, Kamau, and Navarette were dismissed without prejudice for lack of personal involvement. M. Cristo, Inc. v. State of New York Office of General Services

Greenaway v. Cnty. of Nassau

In re Arbitration between New York State Department of Correctional Services & New York State Correctional Officers

Westchester County Corr. Officers Benevolent Assn., Inc. v. County of Westchester

Matter of Nassau County Sheriff's Correction Officers Benevolent Assn., Inc. v. Nassau County

John Thomas, a correction officer, sustained a back injury in 1998 and subsequently received General Municipal Law § 207-c benefits. After periods of restricted duty and military service, medical evaluations in 2009 determined he was unfit for any duty, reinstating his benefits. However, in February 2010, a County-appointed doctor deemed him fit for light-duty work, leading the Nassau County Sheriff's Department to discontinue his benefits. Thomas and his labor union challenged this decision, arguing a due process violation due to the hearing officer placing the burden of proof on Thomas to demonstrate his unfitness. The Appellate Division, Second Department, affirmed the lower court's dismissal, concluding that Thomas was afforded due process as he had the opportunity to present evidence and requiring him to support his claim of continued total disability was permissible.

Matter of Singleton v. New York State Off. of Children & Family Servs.

Petitioner Charles Singleton challenged the termination of his employment by the New York State Office of Children and Family Services (OCFS) following the expiration of his workers' compensation leave. He contended that his work-related injury was assault-related, entitling him to a two-year leave rather than the one-year leave OCFS granted for a non-assault injury. After his employment was terminated, Singleton initiated a CPLR article 78 proceeding seeking reinstatement or a post-termination hearing to dispute the injury classification. The Supreme Court dismissed his petition as untimely, ruling that the four-month statute of limitations began when he received OCFS's August 25, 2015 letter classifying his injury. The Appellate Division affirmed this decision, finding that the classification became final and binding upon receipt of the letter, as no administrative procedure existed for challenging such a determination.
