Noureddine Manser vs. Return-to-Work Supplement Program

Applicant Noureddine Manser sought reconsideration of a November 9, 2023 finding that he was not entitled to a second Return-to-Work Supplement Program (RTWSP) benefit under Rule 17302(b), which prohibits a second benefit unless for a subsequent injury. DEXTER HAYNES vs. TRANSFORCE, INC.; RETURN-TO-WORK SUPPLEMENT PROGRAM

Velella v. New York Local Condotional Release Commission

The petitioners, including Gonzalez, Caba, Stephens, Velella, and DelToro, challenged determinations by the Conditional Release Commission and the Department of Correction. These determinations advised petitioners that their conditional releases were invalid and directed them to surrender. The Supreme Court, New York County, denied their five CPLR article 78 petitions. This appellate court unanimously affirmed the Supreme Court's decision, finding the petitioners' conditional releases illegal due to non-compliance with Correction Law § 273 (1) and (6). The court also ruled that the agencies had the power to set aside determinations based on significant irregularities and that the petitioners had no substantive due process right to illegal orders, having been afforded adequate procedural due process through the CPLR article 78 proceedings.

Allen v. Riese Organization, Inc.

Plaintiffs, former maintenance workers, were terminated and signed severance agreements releasing all employment-related claims, including those under human rights laws, in exchange for severance pay. Approximately three years later, they filed a lawsuit against their former employer, A.R.O. Construction Corp., alleging race discrimination, retaliation, and a hostile work environment. Defendants moved to dismiss the complaint, arguing the releases barred the claims. While plaintiffs contended the releases were procured by duress and fraud, the appellate court determined that plaintiffs had ratified the agreements by accepting the severance payments and failing to promptly repudiate the releases. Consequently, the appellate court reversed the lower court's denial of the motion to dismiss and ordered the dismissal of the plaintiffs' complaint.

LISA FOWLER vs. AUTOMOBILE CLUB OF SOUTHERN CALIFORNIA, LIBERTY MUTUAL

The Workers' Compensation Appeals Board granted reconsideration and reversed a prior finding that Automobile Club of Southern California discriminated against Lisa Fowler under Labor Code section 132a. The Board found Fowler failed to establish a prima facie case of discrimination because her termination resulted from her failure to return to work after being released by her physician, in accordance with a uniformly applied company attendance policy. The employer's witness testified that work-related and non-work-related leaves were treated the same. Therefore, Fowler was not singled out for disadvantageous treatment compared to similarly situated employees.

Matter of Soliman v. Suffolk County Dept. of Pub. Works

Nader I. Soliman, a Senior Civil Engineer for Suffolk County Department of Public Works, was terminated after an arbitration award found him guilty of misconduct for accessing unauthorized, sexually explicit websites during work hours. Matter of Reyes v. H & L Iron Works Corp.

A claimant appealed a Workers' Compensation Board decision which found he violated Workers' Compensation Law § 114-a and permanently disqualified him from future indemnity benefits. The claimant, Leonel Reyes, sustained work-related injuries in 2016 and received benefits. However, he failed to fully disclose his disc jockey activities and the physical nature of this work to the Board, carrier, and examining physicians while collecting benefits. Surveillance videos showed him lifting heavy equipment, contradicting his testimony.
