Claim of Martin v. Fulton City School District
Claimant, an eighth grade English teacher, developed numerous physical ailments including chronic rhinosinusitis and upper airway irritation, which she attributed to poor indoor air quality, dampness, and mold growth in her school building. Initially, a Workers’ Compensation Law Judge found a causally related occupational disease, granting her benefits. However, the Workers’ Compensation Board reversed this decision, ruling her condition was not an occupational disease and failing to address her argument of an accidental injury. The Appellate Division found the Board erred by not considering the accidental injury claim. Consequently, the court reversed the Board's decision and remitted the matter to the Workers' Compensation Board for further proceedings to determine if a compensable accidental injury was sustained.
