Hatcher v. Augustus

The plaintiff, Philip Hatcher, a 7-Eleven store manager, initiated an action under Title VII of the Civil Rights Act against the franchisee, Warner Augustus, and the franchisor, Southland Corporation. Hatcher alleged wrongful termination based on his religion after being fired for refusing to work on Sunday mornings. In re Clumber Transportation Corp.

Clumber Transportation Corporation and Poppy Cab Corporation appealed decisions from the Workers’ Compensation Board. LUCIA MONTES vs. TARGET CORPORATION

Gampietro v. Lehrer McGovern Bovis, Inc.

Plaintiffs Nicholas Gampietro and others sought damages for injuries sustained by Nicholas Gampietro when an abandoned gas line pipe fell on him while he was installing a water line in a trench. They asserted claims under Labor Law §§ 200, 240 (1), and 241 (6) against defendant corporations, who were construction managers for the Dormitory Authority of the State of New York. The Supreme Court partially denied defendants' motion for summary judgment and granted plaintiffs' cross-motion for partial summary judgment on the Labor Law § 240 (1) claim. The appellate court modified the order, denying plaintiffs' cross-motion and granting defendants' motion for summary judgment to dismiss the Labor Law § 240 (1) claim and the Labor Law § 241 (6) claim premised on 12 NYCRR 23-1.7 (a) (1). The court concluded that Labor Law § 240 (1) was not applicable as the pipe was not being hoisted or secured, and the hazard was not contemplated by the statute. It also found an issue of fact regarding defendants' agency status for Labor Law §§ 200 and 241 (6) claims.

Johnson v. UniFirst Corp.

Plaintiff, an employee of Derrick Corporation, sustained injuries when his uniform, rented from UniFirst Corporation, caught fire. Exxon Mobil Corp. v. Tredegar Corp.

Constantine v. Sperry Corp.

James Constantine, a passenger in a van leased by his employer Sperry Corporation, was injured when the van, operated by a fellow employee Oligario, struck a curb. The plaintiffs appealed a judgment denying their motion for summary judgment and granted the defendants' cross motion, dismissing the complaint. The court affirmed the judgment, finding that Constantine's injuries arose out of and in the course of his employment, making his sole remedy the Workers' Compensation Law. Consequently, both the employer and co-worker were immune from suit, and no liability could be imputed to the van owner, Gelco Corporation. The derivative claim by Constantine's wife was also dismissed.

Cintas Corp. v. Unite Here
