Claim of Evangelista v. N.Y.C. District Council of Carpenters
This case concerns an appeal from a Workers’ Compensation Board decision, filed on August 16, 1979, which granted death benefits to the widow of a decedent. The decedent, who served as both a business agent for Local 385 and a delegate to the district council, was shot and killed while performing his duties auditing the council's records. The Board determined that his death occurred in the course of his employment and mandated that the death benefits be awarded against the district council. The appellate court found substantial evidence supporting the Board's findings. Consequently, the Board's decision was affirmed, with costs allocated to the respondent Uninsured Employers’ Fund.
