Rossi v. Doka USA, Ltd.
Plaintiff Domenick Rossi, a carpenter, sustained injuries while using a ratchet at a World Trade Center construction site, asserting a product liability claim against defendant Doka USA, Ltd., which supplied the tool. The Supreme Court dismissed Rossi's complaint for spoliation of evidence (the missing ratchet) and denied his cross-motion for sanctions against Doka for alleged email destruction.
