Corbett v. Hogan
The plaintiff appealed a Supreme Court order that denied his motion for partial summary judgment on his Labor Law § 240 (1) claim and granted the defendant's cross-motion for summary judgment dismissing that cause of action. The plaintiff argued that he was injured due to the defendant's violation of Labor Law § 240 (1) and was therefore entitled to summary judgment on liability. The Appellate Court affirmed the Supreme Court's decision, finding that Labor Law § 240 (1) protects workers from extraordinary elevation-related hazards, which was not the case here. The plaintiff was injured on the ground while carrying a ladder, which toppled and caused him to hyperextend his arm. The court concluded that the plaintiff was exposed only to the usual and ordinary dangers of a construction site, specifically those involved in moving a heavy object at the same level as the worker, and thus was not entitled to recover under the statute.
