Curry v. Travelers Insurance Co.

Alice Nelson Curry appealed a judgment in a workmen’s compensation case against Travelers Insurance Company and Jensens, Inc. Her husband, Buford Curry, suffered a fatal myocardial infarction at work. Carrenard v. Shalala

The plaintiff sought judicial review of the Secretary's decision denying disability benefits. The case involved applications for disability insurance and Supplemental Security Income, initially denied by an Administrative Law Judge (ALJ) in August 1990. The Appeals Council remanded the case after a treating physician, Dr. Alix Dufresne, submitted a residual functional capacity evaluation. A subsequent ALJ hearing again found the plaintiff not disabled, which the Appeals Council affirmed. The District Court found that the ALJ erred in interpreting "past relevant work" and misquoted a vocational expert's testimony. The court also determined that the ALJ failed to correctly apply the Medical-Vocational Guidelines based on the plaintiff's age and work capabilities. Consequently, the court reversed the Secretary's determination and remanded the case for calculation of benefits.
